Terms of Service

Aktive Studio provides subscription-based graphic and product design services delivered through our client portal. By subscribing, you gain access to our team and platform to submit, manage, and receive design work for the duration of your active subscription.

These Terms govern your use of the Aktive platform and services. By using the platform or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the service.

We may update these Terms from time to time. We will notify you of material changes by email. Continued use of the service after changes take effect constitutes acceptance.

You must be at least 18 years old to create an account. You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account.

You may not share account access or transfer your subscription to another party. If you believe your account has been compromised, notify us immediately at hello@aktivedesign.com.

Subscriptions are billed monthly in advance. Your subscription auto-renews at the end of each billing period unless you cancel before the renewal date.

• 7-day trial — New subscriptions include a 7-day satisfaction period. If you're not happy with the service, contact us within 7 days of your first charge and we'll issue a prorated refund for any unused days — no questions asked. Due to the high-quality nature of the work, no refunds will be issued past the first week of service.
• Completed work — No refunds will be issued for work that has already been completed and delivered, regardless of when the request is made.
• Pausing — You may pause your subscription at any time. Paused subscriptions retain portal access through the end of the current billing period. No charges occur while paused.
• Price changes — We may change subscription prices with 14 days' advance notice. If you do not agree with a price change, you may cancel before it takes effect.

All payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis.

We target a 48-hour turnaround on active requests, though delivery times may vary based on complexity and current queue. Turnaround times are targets, not guarantees.

All subscriptions include unlimited revision requests on active work. A revision is a refinement of an approved direction. Requests that constitute a new direction or significant scope change may be treated as new requests.

We deliver work in formats specified in your request (Figma, PDF, PNG, SVG, etc.). Source files are included in deliverables unless otherwise specified.

Upon receipt of full payment for the subscription period in which work was delivered, all rights, title, and interest in the deliverables — including all intellectual property rights — transfer to you.

If a subscription payment fails or is reversed, rights to work delivered during that period revert to Aktive Studio until payment is resolved.

We retain the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing. Confidential work can be excluded from our portfolio — just let us know.

We retain all rights to our tools, processes, templates, and general design methods. These are not transferred as part of deliverables.

To get the best results, you agree to:

• Provide clear briefs, brand assets, and reference materials as needed
• Give timely, actionable feedback on work in progress
• Ensure you have the right to use any third-party content (fonts, photos, trademarks) you submit to us
• Not submit requests for unlawful, defamatory, or infringing content

We are not responsible for delays caused by incomplete briefs, slow feedback, or missing assets.

You may not use the Aktive platform or services to:

• Create content that infringes third-party intellectual property rights
• Produce illegal, defamatory, harassing, or fraudulent materials
• Attempt to reverse-engineer, scrape, or interfere with platform infrastructure
• Resell or sublicense access to the platform without written permission

We reserve the right to refuse or remove requests that violate these terms or our discretion, and to terminate accounts that repeatedly violate acceptable use.

To the maximum extent permitted by law, Aktive Studio's total liability for any claim arising from these Terms or the service is limited to the amount you paid in the 30 days prior to the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, or data — even if we have been advised of the possibility of such damages.

We make no warranty that the service will be uninterrupted, error-free, or meet every specific design need. Design is subjective, and we commit to good-faith effort and unlimited revisions, not guaranteed outcomes.

You may cancel your subscription at any time through the client portal or by emailing us.

We may suspend or terminate your access if you violate these Terms, fail to pay, engage in abusive conduct toward our team, or for any other reason at our discretion with reasonable notice. In cases of serious violation, termination may be immediate.

Upon termination, your right to use the platform ceases. You retain rights to work delivered and fully paid for prior to termination.

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes will be resolved through good-faith negotiation first, and if unresolved, through binding arbitration in Colorado.
