Terms of Service

Aktive provides design subscriptions, scoped creative engagements, related services, and client portal access for request communication and delivery. By engaging Aktive or using the portal, you gain access to our team and platform to submit, manage, and receive work tied to your active engagement.

These Terms govern your use of the Aktive platform and services. By using the platform or purchasing a subscription or related engagement, you agree to these Terms. If you do not agree, do not use the service.

We may update these Terms from time to time. We will notify you of material changes by email. Continued use of the service after changes take effect constitutes acceptance.

You must be at least 18 years old to create an account. You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account.

You may not share account access or transfer your subscription to another party. If you believe your account has been compromised, notify us immediately at hello@aktivedesign.com.

Aktive engagements may be structured as design subscriptions, scoped project work, or ongoing retained support. Billing terms are defined in your proposal, checkout flow, invoice, or written agreement.

• Payment timing — Unless otherwise agreed, work begins after payment or deposit is received.
• Completed work — No refunds will be issued for work that has already been completed and delivered, regardless of when the request is made.
• Rescheduling or pause — If work is delayed or paused, any rescheduling is handled in good faith based on capacity and the existing agreement.
• Price changes — Aktive may update public pricing or packaging over time, but those changes do not retroactively change an already accepted agreement unless both sides approve it.

All payments are processed by Stripe or another agreed payment method. By purchasing an engagement, you authorize the agreed charges for that work.

Aktive works in focused delivery cycles, but delivery times may vary based on complexity, scope, and the active engagement structure. Any turnaround references are targets, not guarantees.

Reasonable revisions are included within the agreed engagement. A revision is a refinement of an approved direction. Requests that create a new direction or materially expand scope may be treated as new work.

We deliver work in formats specified in your request (Figma, PDF, PNG, SVG, etc.). Source files are included in deliverables unless otherwise specified.

Upon receipt of full payment for the engagement period in which work was delivered, all rights, title, and interest in the deliverables — including all intellectual property rights — transfer to you unless otherwise agreed in writing.

If payment fails or is reversed, rights to work delivered during that period revert to Aktive until payment is resolved.

We retain the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing. Confidential work can be excluded from our portfolio — just let us know.

We retain all rights to our tools, processes, templates, and general design methods. These are not transferred as part of deliverables.

To get the best results, you agree to:

• Provide clear briefs, brand assets, and reference materials as needed
• Give timely, actionable feedback on work in progress
• Ensure you have the right to use any third-party content (fonts, photos, trademarks) you submit to us
• Not submit requests for unlawful, defamatory, or infringing content

We are not responsible for delays caused by incomplete briefs, slow feedback, or missing assets.

You may not use the Aktive platform or services to:

• Create content that infringes third-party intellectual property rights
• Produce illegal, defamatory, harassing, or fraudulent materials
• Attempt to reverse-engineer, scrape, or interfere with platform infrastructure
• Resell or sublicense access to the platform without written permission

We reserve the right to refuse or remove requests that violate these terms or our discretion, and to terminate accounts that repeatedly violate acceptable use.

To the maximum extent permitted by law, Aktive's total liability for any claim arising from these Terms or the service is limited to the amount you paid in the 30 days prior to the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, or data — even if we have been advised of the possibility of such damages.

We make no warranty that the service will be uninterrupted, error-free, or meet every specific design need. Design is subjective, and we commit to good-faith effort and unlimited revisions, not guaranteed outcomes.

You may cancel or end a future engagement at any time through the client portal or by emailing us, subject to any active agreement already in progress.

We may suspend or terminate your access if you violate these Terms, fail to pay, engage in abusive conduct toward our team, or for any other reason at our discretion with reasonable notice. In cases of serious violation, termination may be immediate.

Upon termination, your right to use the platform ceases. You retain rights to work delivered and fully paid for prior to termination.

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes will be resolved through good-faith negotiation first, and if unresolved, through binding arbitration in Colorado.

Use of the public website and client portal is also governed by the Aktive Privacy Policy. Optional analytics may be used on public pages only after analytics consent, and account or request data may be processed by service providers needed to operate hosting, billing, storage, security, and delivery workflows.
